"The owner of any dog which shall bite a person while such person is on or in a public place, or lawfully on or in a private place, including the property of the owner of the dog, shall be liable for such damages as may be suffered by the person bitten, regardless of the former viciousness of such dog or the owner's knowledge of such viciousness."

In other words, the owner is liable for the attack regardless of whether the dog has previously shown aggressiveness toward people. There's no requirement that the owner have any indication that their dog is dangerous.

Negligence

In that case, the theory of negligence can apply. Negligence refers to a person who acts unreasonably and causes another's injury. To prove liability for a dog bite under a theory of negligence, you must prove that the owner of the dog reacted unreasonably under the circumstances. The most common way to do this is to show that the owner had knowledge of previous vicious acts by the dog. If this is the case, it follows that the owner failed to take reasonable precautions to protect the public from their dog.
