With the COVID-19 pandemic taking the entire world by storm, many people are wondering how this is going to impact them. The reality is that COVID lawsuits are going to be filed all over the world and this includes Canada. It is important to note that the information below is relevant only to Canada and might not be relevant to other jurisdictions. There are a few major topics that are going to unfold when it comes to Canada and lawsuits related to the pandemic.

The first topic to note that there really isn't a precedent for anything like this. The last time the world saw a pandemic of this magnitude was more than 100 years ago. It should go without saying that many things have changed since this time. The landscape or the legal industry back in 1918 was very different back then. Canada was a very young country and the population of the country is nothing like it is today. This means that there might not be a lot of case law that lawyers can work with. Without any legal precedents to fall back on, it could be difficult for lawyers to figure out what works and what doesn't.

One of the most important fields that will have to be addressed when it comes to Canada and COVID-19 lawsuits is employment law. Many businesses are starting to reopen and it is a reality that someone is going to test positive. This could be an employee. This might be a customer. What does this mean for the business as a whole? If the business is open when the government says it is supposed to be closed, that is one thing; however, is it really possible to prove that the business is responsible for someone getting sick? This is one of the most important questions that will have to be answered.

Next, what does the virus mean for homeowners? What if someone has been laid off and cannot afford to pay their mortgage? Are there protections for this person? Could the bank really file a lawsuit against a homeowner? What are the rights of the lender and the homeowner? This is another important topic that will have to be addressed.

These are just a few of the most important points that everyone should keep in mind when it comes to Canada and COVID lawsuits. While it is important to note that there could be a lot of opportunities for the legal industry in this field, it is also critical to recognize that the legal industry is entering into uncharted territory. With massive global health and economic crises continuing to unfold, it will be interesting to see what happens next.
