New York Judge Dismissed Lawsuit Against Trump Over Nasty Tweets

By

The lawsuit brought by Cheri Jacobus, a GOP political consultant who claimed that her business was harmed by a series of tweets and on-air appearances by President-elect Donald Trump and his campaign has been dismissed by New York judge on Tuesday.

Longtime political consultant Jacobus briefly in talks to join the campaign and went on to comment on the race, filed the $4 million suit last April.

According to Judge Barbara Jaffee, the "heated rhetoric" amid a "particularly raucous Republican Primary" serve as major and important context for the tweets that were demeaning, but they did not reach to the level of defamation.

Jaffe, in her 20-page ruling, according to USA TODAY describe Trump's bombastic Twitter profile "rife with vague" and simplistic insults such as 'loser' or 'total loser' or 'totally biased loser,' 'dummy' or 'dope' or 'dumb,' 'zero/no credibility,' 'crazy' or 'wacko' and 'disaster,' all deflecting serious consideration."

Trump on Feb. 5 2016 tweeted out "Really dumb @CheriJacobus. Begged my people for a job. Turned her down twice and she went hostile. Major loser, zero credibility!"

Jacobus' attorney Jay Butterman said that the ruling will be appealed and further describe that it is "a sad day for free speech, a sad day for freedom of the press and sad day for democracy."

Butterman said that what the court is doing "is allowing defamation in the context of political speech.

"Trump can now eliminate his critics by dominating the media," said Butterman, who appears to be so upset with the verdict that gave Trump a free pass to trample on the rights of free speech of any critic.

Judge Jaffe, ultimately has ruled that the Republican candidate - then U.S President-elect's tweets veered into opinion and were not able to be measured as factual.

According to Jaffe's notes, she describes that the truth itself has been lost in the cacophony of online and Twitter verbiage to such a degree, and that it seems to roll off the consciousness like water off a duck's back.

About 75 lawsuits were filed to Trump as of Election Day.
